COMPENSATION CAMPAIGN : NHS SERVICE CONCERNS

COCOO.uk is initiating a compensation campaign for individuals who believe they have suffered direct harm due to systemic failures in the commissioning, provision, or regulation of NHS services, particularly concerning access to NHS dentistry, mental health services, and the quality and safety of care. Potential affected parties include patients who have been unable to access necessary NHS dental treatment leading to pain, deterioration, or the need to incur private costs; individuals who have faced unreasonable delays or inadequate access to NHS mental health services resulting in worsening conditions or distress; and patients who may have been harmed by unsafe or substandard practices in healthcare settings, including mental health facilities, where regulatory oversight by bodies such as the Care Quality Commission (CQC) or commissioning by Integrated Care Boards (ICBs) may have been deficient. This also extends to individuals whose human rights may have been breached within NHS-funded care, particularly in outsourced services where accountability mechanisms might be unclear.

COMMON HARM

The common harm we are investigating arises from alleged systemic failures within the NHS framework. This includes the widespread lack of access to essential NHS care in certain sectors like dentistry, creating “dental deserts”, and similarly long waiting times for mental health support. Such common experiences suggest potential failings in how services are commissioned to meet reasonable population needs and in upholding duties to reduce health inequalities. Furthermore, there is a common risk of exposure to substandard care if regulatory bodies like the CQC do not effectively monitor and ensure provider compliance with safety and quality standards, including Mental Health Act provisions

WHY THIS CAMPAIGN IS NECESSARY

This campaign is necessary because significant concerns have been raised, through COCOO.uk’s investigations and broader public evidence (including High Court findings against the CQC and critical reports on regulatory performance ), about the adequacy of NHS service commissioning and regulatory oversight. Decisions by the Department of Health and Social Care (DHSC) regarding NHS structures (like the abolition of NHS England ) or the funding and implementation of crucial legislation like the Mental Health Act 2025 may also contribute to risks in service delivery. COCOO.uk has formally engaged with NCL ICB, East Dentistry, the CQC, and DHSC regarding these concerns, urging transparency and reform. This compensation campaign aims to identify individuals who have suffered tangible harm as a result of these alleged systemic failings and to explore collective pathways for redress and accountability

ACTUAL AND POTENTIAL HARM

Potential causes of action that may lead to compensation primarily involve claims in tort for negligence and claims for damages under the Human Rights Act 1998. Negligence claims could potentially be brought against NHS commissioning bodies (ICBs) by patients who suffered foreseeable harm (such as worsened health or financial loss from seeking private care) due to a failure to ensure reasonable access to dental or mental health services. There could also be potential (though often complex) claims related to alleged regulatory negligence by bodies like the CQC if their failure to effectively regulate a provider directly contributed to patient harm, or against DHSC if policy decisions led to foreseeable harm at the delivery level. Human Rights Act claims may arise if failures in care or access breach rights such as Article 3 (freedom from inhuman or degrading treatment) or Article 8 (right to private and family life). The perjuicios, or harms, for which compensation may be sought include physical injury or deterioration of health, psychological distress, pain and suffering, and financial losses directly incurred due to the inability to access timely and appropriate NHS care or due to substandard treatment

PHASE 1: Identification of systematic deficiencies in compliance with legislation that protects consumers, competitors, and the public interest.

PHASE 2: Identification of potentially affected parties and uniting them through this platform. Most victims never receive compensation and never find out that they are victims entitled to compensation or restitution.
